Terms of sale

These terms apply when you buy from this site or place an order with us by phone. Placing an order means you accept them.

Who you are buying from

Prairie Equipment Company, LLC, doing business as Grappler Specialty Products, in Victoria, Minnesota. (952) 949-2430, sales@grapplerusa.com.

Prices and quotations

  • Prices are in US dollars and do not include sales tax. Shipping is shown separately before you pay.
  • The price you pay is the one shown at checkout. Prices on the site can change without notice, but not on an order you have already placed.
  • A quotation is valid for 30 days from its date, unless it says otherwise.
  • If a price is shown wrongly because of an obvious error, we will contact you before shipping and you can cancel for a full refund.

Trade pricing and promo codes

  • Trade and account pricing is offered at our discretion, applies once we have approved it, and can be changed or withdrawn for future orders.
  • A promo code applies only on the terms it was offered on, and cannot be exchanged for cash.

Paying

  • Online orders are paid by card, Apple Pay, Google Pay or Amazon Pay through our payment provider, Stripe. We never see or store your card details.
  • By arrangement, orders placed by phone can be paid by check or on a purchase order.
  • If you order on a purchase order that carries its own terms and they conflict with these, tell us before we ship. We will agree in writing which apply.

Sales tax

  • We collect sales tax where we are registered to, which is currently Minnesota. If we do not charge it, your own state may expect you to pay use tax on the purchase yourself.
  • If you claim a tax exemption, you confirm the certificate details you give us are true and current. If a claim turns out not to be valid, the tax is owed and we will ask you to pay it.

Shipping and delivery

  • We ship to addresses in the continental United States. For Alaska, Hawaii, US territories and military addresses, we quote the freight separately before you pay anything.
  • Delivery times shown are estimates. Items in stock usually ship within one to two business days; some items have a lead time, which is shown on the product page.
  • If the shipping charged at checkout turns out to be too low for an unusual order, we will contact you before charging anything more, and you can choose to cancel instead.
  • Please check the delivery when it arrives. Damage should be reported as set out in our returns and refunds policy.

Using the products safely

  • Lifting equipment. Use sleeve lifters only as the manufacturer's instructions say, within their rated capacity, and never to lift or over people. Inspect them before each use. The manufacturer's manual is on the product page.
  • Confined spaces. The Manhole Debris Catcher reduces the need to enter a manhole. It does not replace your own confined space procedures, permits or atmospheric testing when someone does have to go in.
  • Everyone using these tools is responsible for doing so safely and in line with the rules that apply to their work.

Warranty

Products are covered by their manufacturer's warranty, where there is one, and we will help you make a claim under it. We do not add a warranty of our own. To the extent the law allows, we make no other promises about the products beyond what is written on this site and in the manufacturer's documentation.

Limits on our liability

To the extent the law allows, our liability for any order is limited to the price you paid for it, and we are not liable for indirect losses such as lost profits or downtime. Nothing in these terms limits liability that the law does not allow to be limited, such as for injury caused by negligence.

Your account

  • Keep your password to yourself. Orders placed from your account are treated as yours.
  • We may close an account that is misused.
  • How we handle your information is set out in our privacy policy.

The website

Product photographs, drawings and specification sheets belong to us or to the manufacturers and are used with permission. Please do not copy them for other purposes without asking.

If these terms change

We may update these terms. The terms in force when you place an order are the ones that apply to it.

The law that applies

These terms are governed by the laws of the State of Minnesota. Any dispute will be heard in the courts of Carver County, Minnesota, unless the law gives you the right to bring it somewhere else.
